1.1Scope

Shoot & Cast (Pty) Ltd ("Shoot & Cast", "we", "our" or "us") respects your privacy and is committed to protecting personal information in accordance with the Protection of Personal Information Act, 2013 ("POPIA") and other applicable data-protection laws.

This Policy explains how we collect, use, disclose, store and protect personal information when Customers, Operators, travel agencies, representatives or other Users access or use the Shoot & Cast Platform.

2Information We Collect

• Identity and contact information, including name, ID or passport number, date of birth, address, email and telephone number.
• Booking and travel information, including selected packages, dates, accommodation preferences and booking communications.
• Operator and compliance information, including business registration, banking, licences, permits, vessel and skipper documents, hunting and fishing authorisations, insurance and supplier information.
• Financial and transaction information, including payment confirmations, settlement information, billing records, transaction history, refund status, recovery records and chargeback information.
• Technical information such as IP address, device information, browser type, operating system, cookies, login history and Platform usage information.

3Why We Process Personal Information

• Create and manage Customer and Operator accounts.
• Process Bookings, payments, split settlements and payouts.
• Verify Operators, identities, licences, permits, suppliers and compliance information.
• Communicate with Customers, Operators and travel agencies.
• Administer cancellations, refunds, recovery of funds from Operators, chargebacks and disputes.
• Prevent fraud, protect Platform security and comply with payment-provider requirements.
• Comply with legal, regulatory, accounting and record-keeping obligations.
• Provide customer support and improve the Platform.
• Send service-related communications and, where permitted, marketing communications.

4Refund and Recovery Administration

4.1Processing for Refunds

Where a refund is requested or becomes due, Shoot & Cast may process the Customer's identity, booking, payment, banking, communication and supporting information as reasonably necessary to assess the request, liaise with the relevant Operator, recover funds already settled to that Operator, process or remit a refund, investigate a chargeback or resolve a dispute.

4.2Information Shared for Recovery

For these purposes, Shoot & Cast may share relevant information with the Operator or travel agency responsible for the Booking, authorised payment service providers, banks, professional advisers, insurers, auditors, fraud-prevention service providers, regulators or law-enforcement authorities where reasonably necessary and lawful. We will not disclose more personal information than is reasonably necessary for the relevant purpose.

5Sharing Information

• The Operator responsible for delivering the booked Experience.
• Customers, only to the extent necessary to provide relevant Operator or Experience information.
• Authorised payment service providers and financial institutions.
• Technology, hosting and fraud-prevention providers.
• Professional advisers, auditors and insurers.
• Competent conservation, maritime, tourism, law-enforcement or other regulatory authorities where required or permitted by law.
• Other parties where the User has authorised disclosure or where applicable law permits it.

5.1No Sale of Personal Information

Shoot & Cast does not sell personal information.

6Protection of Information

6.1Security

Shoot & Cast implements reasonable administrative, technical and organisational safeguards designed to protect personal information and uploaded compliance documentation against loss, misuse, unauthorised access, alteration and unlawful disclosure. No internet-based system can guarantee absolute security.

7International Processing

7.1Cross-Border Experiences

Shoot & Cast primarily operates from South Africa. Where an Experience takes place outside South Africa or a third-party service provider processes information outside South Africa, reasonable steps will be taken to ensure that any cross-border transfer complies with applicable data-protection law.

8Data Retention

8.1Retention

Personal information, payment records, refund and recovery records, Operator compliance records and related communications will be retained only for as long as reasonably necessary to provide services, administer Bookings and Operators, process refunds and recoveries, comply with legal or financial obligations, resolve disputes, prevent fraud and enforce agreements. Information no longer required will be securely deleted, destroyed or anonymised where appropriate.

• Request access to personal information held about you.
• Request correction of inaccurate or incomplete information.
• Object to certain processing where legally permitted.
• Request deletion where legally permissible.
• Withdraw consent where processing is based on consent.
• Lodge a complaint with the Information Regulator where applicable.

10Cookies and Communications

The Platform may use cookies and similar technologies for login, functionality, security, analytics and user preferences.

10.2Communications

Users may receive service-related communications relating to Bookings, payments, refunds, recovery efforts, compliance, security and legal notices. Marketing communications will be handled in accordance with applicable law and available opt-out rights.

The Platform is intended for persons aged 18 years or older. Shoot & Cast does not knowingly collect personal information from children through the Platform.

12Changes to this Policy

12.1Updates

Shoot & Cast may update this Privacy Policy to reflect changes in law, technology, payment and refund processes, Operator onboarding requirements or business operations. The latest version will be published on the Platform with its effective date.
